Well, true or not Dick Cheney has been trying to make it common law and, as often happens with greedy power hungry politicians, he's hoping that not enough people will see what's going on until it's too late. So if you think you should be allowed to freely talk on the phone without worrying about being spied on just because someone "thinks" there's a chance that they "might" catch you saying something incriminating then it's time to step up and do something about it.
I think that Benjamin Franklin said it best when he said "Sell not virtue to purchase wealth, nor Liberty to purchase power". If you're unfamiliar with that quote then maybe you'll recognize it by one of its more commonly used variants like "Those Who Sacrifice Liberty For Security Deserve Neither" or "If we restrict liberty to attain security we will lose them both". Regardless of how you've heard it the message remains the same and that message is that if you're not willing to fight for it then you probably don't deserve it anyhow.
